Terms and Conditions of Sales thewell.no

This purchase is governed by the sales terms below for consumer purchases of goods via the internet. Consumer purchases online are primarily regulated by the Norwegian Contract Act, Consumer Purchase Act, Marketing Act, Right of Withdrawal Act, Package Travel Act, and the E-commerce Act, which provide the consumer with non-waivable rights. These laws are available at lovdata.no. The terms of this agreement should not be seen as a limitation of your statutory rights but outline the most important rights and obligations for purchases with us for both parties.

The sales terms are developed and recommended by the Norwegian Consumer Authority.

  1. General

These sales terms apply to all purchases made through our website – thewell.no.

Buyer: The person listed as the buyer in the order and hereafter referred to as the guest, or you, your, yours.

The sales terms, along with your order and order confirmation, constitute the purchase agreement.

All prices include VAT where applicable.

 

  1. Agreement Formation

An order completed on thewell.no is binding. Thewell.no is bound by the price stated at the time of the completed order and as confirmed in your order confirmation. The hotel reserves the right to adjust prices due to increased taxes, duties, or other circumstances beyond the hotel's control.

The agreement is not binding if there has been a typographical or input error in the order solution or the buyer's order, and the other party realized or should have realized this mistake.

 

  1. Payment

Spa
Total payment is due immediately before an order is confirmed. Payment can be made by credit card or through Vipps. The full amount is charged upon booking. Refund rules vary depending on the product or service purchased. See Section 6 for details.

Hotel
The agreed price is paid upon check-in. A bank guarantee for the total estimated cost must be received according to the conditions stated in the booking confirmation. Late payments incur interest according to Norwegian late payment interest law. The hotel reserves the right to require a deposit. Refund rules vary depending on the product or service. See Section 6 for details.

 

  1. Card Payments

We do not retain card numbers beyond what is necessary for effective management of charges, reservation releases, or refunds. Payments on thewell.no are processed through our payment provider, Adyen.

 

  1. Delivery

Product delivery occurs at the location and time indicated on the order confirmation.

Booked hotel rooms are guaranteed to be ready for check-in after 4:00 PM on the day of arrival and available until 11:00 AM on the day of departure.

Rooms may be kept beyond this time upon agreement with the hotel. Contact reception at check-in to book a late check-out.

For guaranteed reservations made with company payment or credit card, the hotel is obligated to offer the guest a room for the booked number of nights. The reservation will be charged in full in case of cancellation or no-show.

 

  1. Cancellation Policy

These are general cancellation terms. Certain products may have specific cancellation terms stated directly on the product or service. These will take precedence over the general terms. All changes and cancellations must be made in writing to be valid.

  • Spa entrance / packages: Non-refundable.
  • Spa treatments: Must be canceled no later than 24 hours before the appointment. After this, cancellations are not accepted. This also applies to treatments included in packages (spa or hotel). Valid cancellations will be fully refunded.
  • Hotel packages: Must be canceled no later than 48 hours before check-in. Exceptions are overnight stays with breakfast and spa access, which can be canceled free of charge up to 24 hours before arrival. After 4:00 PM, The Well reserves the right to cancel reservations not checked in and not guaranteed by credit card or other payment guarantees, without obligation to notify the guest. No-show is considered an invalid cancellation. Reservations not canceled within the deadline will be charged.

All cancellations or changes must be made by contacting The Well – via email at booking@thewell.no.

 

  1. Liability for Damages

The person making the booking is financially responsible for any damage to the premises due to negligence or irresponsible behavior by the guests.

 

  1. Disputes

Any disputes arising between the parties in this agreement or on other grounds shall be governed by Norwegian law. If disputes cannot be resolved amicably, the hotel’s local court jurisdiction applies.

 

  1. Force Majeure

Events beyond the control of the parties – such as strikes, lockouts, fires, etc. – that make it impossible to fulfill obligations under this agreement entitle the parties to cancel the agreement without liability for compensation.

 

  1. Age Limit

Please note that The Well is an adult-only hotel and that there is an 18-year age limit for all hotel facilities. This also applies to children and infants.

  1. Guest Agreement

We ask all our guests to familiarize themselves with our guest agreement before arrival. To complete a booking on thewell.no, the guest agreement must be accepted. The current guest agreement is always available on our website – thewell.no.
